Website Terms of Use & General Disclaimers

Last updated: 15 October 2026

1. About these Terms

These Website Terms of Use and General Disclaimers (the “Terms”) apply to your access to and use of the NetSide Padel website at https://www.netsidepadel.co.uk/ and any replacement or related page that links to these Terms (the “Website”).

The Website is operated by NETSIDE PADEL LTD (“NetSide”, “we”, “us” or “our”). Our registered office is 71–75 Shelton Street, London, England, WC2H 9JQ and our company number is 16751057. Our contact email is hello@netsidepadel.co.uk.

By accessing or using the Website, you agree to comply with these Terms. If you do not agree to them, you must not use the Website.

These Terms govern use of the Website only. They do not create, and must not be treated as, a contract for a booking, membership, coaching, event, venue access, payment or any other service.

2. Website information and general disclaimers

The Website is provided for general information and promotional purposes. Information about NetSide, padel, proposed locations, facilities, events, partners, availability, timings and future services may change as plans develop and may not be complete, current or suitable for your particular circumstances.

Any proposed location, opening date, facility, service, partnership, event, price or availability referred to on the Website is indicative unless expressly stated to be confirmed. It may be subject to planning permission, landowner consent, funding, licensing, construction, supplier availability, commercial approval or other matters outside NetSide’s control. We will not describe a matter as confirmed unless we have a reasonable basis for doing so.

Website content is not an offer capable of acceptance and does not create a promise that any proposed location, facility, service, event, price or opening date will proceed. Before making any decision or commitment, you should check the latest material details with NetSide or, where applicable, the relevant third-party platform.

Nothing in this section excludes or limits any liability or consumer right that cannot lawfully be excluded or limited, including liability arising from misleading information or from information that forms part of a separate service contract.

To the fullest extent permitted by law, the Website and its content are provided on an “as available” basis. We do not promise that the Website will always be available, uninterrupted, secure, error-free, free from viruses or other harmful components, or that defects will always be corrected. We may amend, suspend or withdraw any part of the Website without notice.

We are not responsible for delay, interruption or unavailability caused by matters outside our reasonable control, including failures affecting hosting, internet access, telecommunications, email, social-media platforms, third-party services, utilities, cyber incidents or other external infrastructure.

3. Enquiries, newsletters and other forms

When you submit an enquiry, contact form, newsletter sign-up or other form through the Website, you must:

  1. provide information that is accurate, complete and not misleading;

  2. provide personal information about another person only where you are authorised to do so; and

  3. use the form for its stated purpose and not for unsolicited marketing, spam or unlawful activity.

Submitting a form does not itself create a contract, guarantee a response or constitute acceptance of an offer by NetSide. A contract will arise only where NetSide expressly confirms that it has accepted an offer or agreed to provide a particular service, or where the applicable third-party platform confirms the relevant transaction in accordance with its terms.

We may decline to process, remove or block a submission that we reasonably consider unlawful, abusive, misleading, harmful, unsolicited or contrary to these Terms. We do not guarantee that every submission will be received, transmitted without error or answered within a particular period.

Our collection, use of personal information submitted through the Website and use of cookies and similar technologies is explained in our Privacy Policy.

If you choose to receive marketing communications, you must provide a separate, clear and affirmative indication of that choice. Marketing communications will identify NetSide and will include a straightforward way to unsubscribe. You may withdraw your marketing consent at any time. Withdrawing marketing consent will not affect any other service or enquiry.

4. Intellectual property

All rights, title and interest in and to the Website and its content are reserved. This includes, without limitation:

  • the NetSide Padel name, trading names, trademarks, logos and brand assets;

  • Website copy, articles, text, photographs, illustrations, video, audio and graphics;

  • the Website’s structure, navigation, page layouts, selection and arrangement of content;

  • the Website’s design, look and feel, underlying code, software and databases; and

  • all associated copyright, trademark, database, design, know-how and other intellectual property rights.

These rights belong to NetSide, its licensors or other identified rights holders. Nothing in the Website or these Terms grants you a licence to use any trademark, logo, brand asset, copy, image, design or other intellectual property except for the limited right to access and view the Website for your own personal, non-commercial use.

You must not, without our prior written permission or the permission of the relevant rights holder:

  • copy, reproduce, republish, modify, adapt, translate, distribute, sell, license or commercially exploit Website content;

  • use any NetSide trademark, logo or brand asset in a way that suggests endorsement, sponsorship, affiliation or ownership;

  • frame, mirror, embed or present the Website or its content as part of another website or service; or

  • remove, obscure or alter any copyright, trademark or proprietary notice.

All rights not expressly granted are reserved.

Nothing in these Terms transfers ownership of your rights in material that you lawfully submit to us. Any use of submitted material is subject to section 4A and our Privacy Policy.

4A. Materials submitted by you

If you send or submit photographs, videos, logos, designs, text, suggestions, feedback or other materials to NetSide, you remain responsible for those materials and confirm that:

  1. you own them or have all permissions necessary for NetSide to receive and use them;

  2. their submission and use by NetSide will not infringe another person’s rights or breach any law or obligation; and

  3. they do not contain unlawful, harmful, defamatory, discriminatory or malicious material.

You grant NetSide a non-exclusive, worldwide, royalty-free licence to store, reproduce and use those materials only to review, respond to or administer the relevant enquiry, collaboration or Website function. NetSide will not use your submitted material in public marketing without an appropriate further permission or other lawful basis.

You must not submit confidential information or unsolicited business ideas that you expect NetSide to keep confidential unless NetSide has expressly agreed in writing to do so.

5. Acceptable use and security

You may use the Website only for lawful, personal and genuine information or enquiry purposes. You must not:

  • scrape, crawl, spider, harvest, data-mine, index or systematically extract Website content, contact details or other data, whether manually or using software, bots, scripts or automated tools;

  • reverse engineer, decompile, disassemble, translate, probe or attempt to discover the source code, architecture or security features of the Website, except to the extent that applicable law expressly permits this;

  • upload, submit, transmit, inject or distribute any virus, worm, ransomware, spyware, Trojan, malicious code, exploit, payload or other harmful material through any form, upload field, comment section or other input mechanism;

  • attempt to gain unauthorised access to the Website, its servers, hosting environment, databases, forms, email systems, accounts or connected networks;

  • interfere with, disrupt, overload, impair or circumvent any security, access-control or technical measure;

  • use the Website to send spam, phishing messages, unsolicited promotions or fraudulent communications;

  • impersonate another person or organisation, misrepresent your affiliation with NetSide, or submit information that is unlawful, defamatory, discriminatory, threatening, abusive, obscene or invasive of another person’s rights; or

  • use the Website in breach of any applicable law or regulation, including the Computer Misuse Act 1990 and laws concerning intellectual property, privacy, fraud and cyber security.

If you identify a suspected security vulnerability, please notify us at hello@netsidepadel.co.uk and do not exploit, disclose or publicise it before we have had a reasonable opportunity to investigate.

We may restrict, suspend or terminate access to the Website where we reasonably believe that a user has breached these Terms or may put the Website, NetSide or another person at risk.

6. Third-party websites, platforms and services

The Website may contain links, embeds or references to third-party websites, booking platforms, social-media pages, mapping services, payment providers, email services or other resources.

NetSide is not responsible for a third-party platform’s availability, content, terms, privacy practices, security, payment processing or performance, except to the extent that applicable law provides otherwise or the relevant matter results from NetSide’s own breach, negligence or failure to exercise reasonable care.

If a third-party processes personal information on NetSide’s behalf, NetSide remains responsible for its own data-protection obligations. Our Privacy Policy explains the relevant processing and sharing arrangements.

You should review the applicable third-party terms and privacy information before using the relevant service or providing personal information. A link to a third-party service does not by itself constitute an endorsement of that service.

7. Limitation of liability

Nothing in these Terms excludes or restricts, or purports to exclude or restrict:

  1. liability for death or personal injury caused by negligence;

  2. liability for fraud or fraudulent misrepresentation;

  3. any liability or consumer right that applicable law does not permit us to exclude or restrict; or

  4. any duty to exercise reasonable care and skill that applies to a separate contract for services.

Subject to the protection above, and to the fullest extent permitted by law, NetSide will not be liable for loss or damage arising solely from:

  1. reliance on general Website information that is not part of a separately agreed service contract;

  2. temporary downtime, interruption, suspension, withdrawal or technical failure of the Website;

  3. failures or outages affecting third-party hosting, internet, telecommunications, email, social-media, mapping, booking, payment or other external services; or

  4. your failure to follow reasonable instructions, warnings or applicable third-party terms.

We will take reasonable care in operating the Website, but we do not guarantee that the Website will be uninterrupted, secure or free from harmful components. We are not responsible for a cyber incident or unauthorised activity to the extent it was not caused by our failure to take reasonable care or by a breach of a legal duty that cannot lawfully be excluded.

Nothing in these Terms affects your statutory consumer rights or prevents you from claiming for loss or damage that is directly caused by NetSide’s breach of a legal duty or failure to exercise reasonable care and skill.

Any limitation or exclusion in these Terms applies only to the extent that it is fair, transparent and permitted by applicable law. Separate service terms may contain additional liability provisions, which will apply only to the relevant service and will not reduce non-excludable rights.

8. Changes to the Website and these Terms

We may update the Website and these Terms from time to time to reflect changes to the Website, our services, technology, security requirements or applicable law. The current version will be posted on this page with its effective date and version number.

A change to these Terms will apply prospectively only. It will not retrospectively remove rights that you have already acquired or change the terms of a booking, membership, event, payment or other service contract that has already been formed, unless the applicable service contract permits the change fairly and lawfully.

Where a change materially affects your rights and it is reasonably practicable to do so, we will provide reasonable notice. For a material change to terms governing an ongoing paid service, we will not rely solely on continued browsing of the Website as evidence that you have accepted the change.

Your continued use of the Website after the effective date of a change will constitute acceptance of the updated Terms only in relation to your subsequent use of the Website and only to the extent permitted by applicable law.

9. Privacy and cookies

Our collection and use of personal information submitted through the Website and our use of cookies and similar technologies are explained in our Privacy Policy.

Where consent is required, we will ask for consent before using non-essential cookies or similar technologies. You can change or withdraw your cookie choices through the cookie settings available on the Website.

The Privacy Policy is incorporated by reference only for the purposes it expressly addresses. They do not create a booking, membership, coaching, event, payment or other service contract.

10. General legal provisions

If any provision of these Terms is held to be invalid, unlawful or unenforceable, it will be modified or severed only to the extent necessary, and the remaining provisions will continue in effect.

A failure or delay by either party to enforce a right does not waive that right. You may not transfer your rights or obligations under these Terms without our prior written consent. NetSide may transfer its rights and obligations where this does not adversely affect your rights.

A person who is not a party to these Terms has no right to enforce any provision of them under the Contracts (Rights of Third Parties) Act 1999.

These Terms, together with the documents expressly referred to in them, constitute the agreement between you and NetSide concerning use of the Website. They do not replace or limit any separate terms that apply to a booking, membership, venue access, coaching, event, payment or other service.

11. Governing law and jurisdiction

These Terms and any non-contractual obligations arising from them are governed by the law of England and Wales.

If you are a consumer, nothing in these Terms affects any mandatory legal rights you have to bring proceedings in the courts of the part of the United Kingdom in which you live or in any other court that has jurisdiction by law. Subject to those mandatory rights, the courts of England and Wales will have jurisdiction over disputes arising from or connected with these Terms or your use of the Website.

If you are using the Website for purposes connected with your trade, business, craft or profession, the courts of England and Wales will have exclusive jurisdiction over disputes arising from or connected with these Terms or your use of the Website.
